The INDUX-R website (‘Website) is provided to you (‘User’) by the members of the INDUX-R consortium, funded by the European Commission under grant no. 101135556, represented in this act by Inventics (‘Website Operator’), for use only under these terms (‘Terms of Use’).

INDUX-R is an application-driven project that has been conceptualized upon existing market demands and societal needs, where XR can make a difference by offering new business propositions and empowering humans. (‘Project’).

By using the Website, the User indicates its agreement to be bound by all of the terms and conditions of these Terms of Use.

1.The Website

1.1. The Website is the main point of publicly available information for the Project (the ‘Materials’). It will be periodically updated with the latest developments from the Project.

1.2. The Website Operator shall make its best efforts to keep the Website updated. Because of this, the Website Operator does not assume any commitment regarding when and how these updates should take place.

2. Scope of Terms of Use

2.1. The Website Operator authorizes the use the Website and the Materials for the User’s personal, noncommercial use (‘License’).

2.2. The Website Operator reserves the right to modify the terms and conditions of these Terms of Use. These changes will be notified to the User upon first access to the Website after any modification is made by the Website Operator.

3. Liability

To the maximum extent permitted by applicable law, in addition to the above disclaimers, in no event will the Website Operator be liable for any consequential, exemplary, special or incidental damages, including any damages for lost data or lost profits, arising from or relating to the products or products software, whether in contract or tort or otherwise arising from (1) any action you may take in reliance on the Materials, (2) the use or inability to use the Website, (3) third party services outside our reasonable control and for the avoidance of doubt and whether or not the relevant loss arises by reason of our negligence.

4. Warranty

4.1. The Website Operator warrants that the Website is free of spyware, trojan horses, viruses, or any other malware at the time of the User’s use.

4.2. No warranty is provided for the Website that is not executable on the device, that has been unauthorisedly modified, handled inappropriately or culpably, combined or installed with inappropriate hardware or software, used with inappropriate accessories, regardless if by the User or by third parties, or if there are any other reasons outside of the Website Operator’s sphere of influence that affect the executability of the Website.

5. Termination

5.1. These Terms of Use are valid until the end of the Project.

5.2. The User’s rights under these Terms of Use will terminate automatically and without notice from the Website Operator if it fails to adhere to any term(s) of this licence.

5.3. Upon the Terms of Use termination, the User shall stop all use of the Website, and destroy all copies, full or partial, of the Website.

6. Third-party terms of agreements and beneficiary

The Website Operator represents and warrants that it will comply with applicable third-party terms of agreement when using the Website.

7. Intellectual property rights

The Website Operator and the User acknowledge that, in the event of any third-party claim that the Website or the User’s possession and use of the Website infringes on the third party’s intellectual property rights, the Website Operator will be solely responsible for the investigation, defence, settlement, and discharge or any such intellectual property infringement claims.

8. Applicable law

These Terms of Use shall be governed by and construed and enforced in accordance with the laws of the Hellenic Republic (‘Greece’), and shall be interpreted in all respects as a Greek agreement. Any claim or action arising from or related to these Terms of Use shall be governed by and construed and enforced in accordance with the laws of Greece. For the avoidance of doubt, and without limiting the generality of the foregoing, this provision expressly applies to any tort claim against the Website Operator. The User unconditionally attorn to the exclusive jurisdiction of the courts of Greece and all courts competent to hear appeals therefrom. The doctrine of forum non conveniens shall not apply in the selection of forum under these Terms of Use.

10. Miscellaneous

10.1. If any of the terms of these Terms of Use should be or become invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones formulated in a way that will achieve the primary purpose.

10.2. Collateral agreements, changes and amendments are only valid if laid down in writing. The preceding clause can only be waived in writing.
